The property

The Estates Samui occupies a secluded grove above Laem Yai Bay on the north-west shoulder of Koh Samui, on the same site as the Four Seasons Resort Koh Samui and reached through the hotel lobby, an estate of fourteen villas. Bill Bensley designed them. Four Seasons Resort Koh Samui was also the principal filming location for the third season of The White Lotus, whose on-screen resort is a composite of five Thai properties.

Minor International PCL sits behind the property, at 88 The PARQ in Bangkok. Four Seasons Resort Koh Samui adjoins the villas; Four Seasons' management of the estate is to be confirmed. Four Seasons itself records the Koh Samui private residences as sold out and lists rentable residence villas at the resort, with nothing for sale directly.

Ownership is the part of this property a buyer most needs in writing. For the completed villas the structure is that the building itself may be held outright in a non-Thai buyer's name, while the land sits either in a Thai company or on a registered lease of thirty years, renewable to ninety years in total; any description of the title as simply freehold cannot be literally true for a foreign individual buying Thai land. For the three villas in the newer phase, the lease term, the company structure and the foreign-ownership position are to be confirmed.

Two markets run side by side here. Completed villas are asked at USD 7,220,217 and USD 7,821,901, and three earlier villa sales went through at THB 210,000,000, THB 225,000,000 and THB 250,000,000. Sold prices, not availability. In the newer phase, Villa 2 is asked at USD 12,500,000 and Villa 3 at USD 12,000,000. Prices in that phase are fixed in US dollars and any baht figure is a conversion at the moment of quoting, which is why dollars are given on this page and baht is not.

The Estates Samui suits a buyer who already knows the resort and wants a house on its land, rather than a buyer working through a shortlist, and who is content to have counsel establish the title structure before anything else happens. The asking prices move, the number of villas for sale at any moment moves with them, and the service charge is to be confirmed. We make an introduction here directly, and put those three questions to Minor International PCL in writing before a client travels to see anything.

How ownership works here

For the completed villas: the building may be owned outright in a non-Thai buyer's name, while the land is held either through a Thai company or on a registered lease of thirty years, renewable to a total of ninety years. A description of the title as simply freehold cannot be literally true for a foreign individual buying Thai land. For the three villas in the newer phase, the lease term, company structure and foreign-ownership position are to be confirmed, with Thai counsel, before any commitment.

Leasehold or freehold: which is better?

Each has its advantages, and we would not steer a buyer to one over the other in the abstract. Freehold is title in perpetuity: the home is yours outright, it passes to your heirs without a clock on it, and it is the simpler asset to finance and to sell to the widest pool of buyers. Leasehold is normally structured to 90 years, as a 30-year registered term with two further 30-year terms written into the contract in Thailand, or as a 99-year term in markets such as Singapore, and it is the route to a villa on its own land where the law keeps freehold land in local hands. On resale a lease is assigned rather than a title transferred, which in Thailand means a fraction of the transfer fees and taxes a freehold sale attracts, and a well-run branded estate keeps its resale value on the strength of the operator and the address rather than the tenure. What matters is the specific home: the years left on the term, how the renewals are secured, and what the purchase pack says about assignment. We put those three questions to the developer or the seller's side before any offer, and we tell you what comes back.

What is available now

Completed villas are asked at USD 7,220,217 and USD 7,821,901. In the newer phase, Villa 2 is asked at USD 12,500,000 and Villa 3 at USD 12,000,000, with the rest of that phase priced on request. The number of villas for sale moves before quoting.

What it costs to run

The service charge, common-area fee and sinking fund for The Estates Samui are to be confirmed; the figures in circulation sit on a stale off-plan payment schedule and we do not use them.

How this works

Via Privata is a travel advisory. We do not sell property and we are not the developer, the seller, or a licensed real-estate broker in any of the markets on these pages. What we do is introduce a buyer to the developer or to the agent selling a home, and stay alongside for the parts we are useful for. The sale is concluded directly between you and them.

Where an introduction leads to a purchase we may be paid a fee by the developer or its appointed agent, and we do not act for both sides of the same transaction.

Every price on these pages was verified by us against a live published asking price on the date shown. Asking prices and availability in this market move constantly, so treat every figure as indicative and as of its stated date, and expect it to be re-confirmed before anything is agreed. Where a figure is not published anywhere, we say so rather than estimate it. Ask us and we will tell you what is available today and arrange the introduction.

In the United Arab Emirates, introductions run through a licensed local brokerage. Dubai requires a Trakheesi permit, issued per advertisement to the brokerage holding the listing, so a UAE property carries an asking price here only where that brokerage's permit number is shown on its page. Where no permit covers a page, the page reports the property and quotes nothing.

Where a residence has a rental programme we describe how it works and nothing more. We publish no yield, no projected return and no occupancy figure, for any property, anywhere.

None of this is investment, tax, immigration or legal advice. Buying across a border has consequences that depend entirely on your own position; take independent local counsel and your own valuation before you commit to anything.
